IF YOU DO NOT AGREE TO THE TERMS OF THIS POLICY, YOU ARE NOT AUTHORIZED TO ACCESS OR USE THE SERVICES AND SHALL IMMEDIATELY DISCONTINUE ANY SUCH ACCESS OR USE.
If you are a resident of the State of California, additional California-specific disclosures are set forth in the Privacy Notice for California Residents appearing below (the "California Notice"). In the event of any conflict or inconsistency between the terms of this Policy and the terms of the California Notice, the terms of the California Notice shall govern and control, solely with respect to California Residents (as defined therein) and solely to the extent of such conflict or inconsistency.
This Policy applies to information collected from or about you through the Services, as well as other information provided to the Company online or offline by third parties. For the avoidance of doubt, this Policy shall not apply to: (a) information collected from the Company's employees, contractors, or vendors; (b) information that you direct or authorize the Company to disclose to third parties; or (c) information collected by third parties whose software or services are featured in, linked to, or integrated with the Services.
This Policy, together with the Terms of Service posted on the Website, as each may be amended from time to time, sets forth the general rules and policies governing your access to and use of the Services. Depending upon your activities in connection with the Services, you may be required to agree to additional terms and conditions, which additional terms and conditions are hereby incorporated by reference to the extent applicable to you.
Certain visitors to the Website elect to interact with AEEM Shipping in ways that require AEEM Shipping to collect information that identifies, relates to, describes, or is reasonably capable of being associated or linked, directly or indirectly, with a particular individual (hereinafter, "Personal Information"). The nature and amount of Personal Information collected shall depend upon the nature of the interaction. Most of the Personal Information collected about you is provided to the Company directly by you, or is obtained by the Company with your authorization, including, without limitation: (a) names; (b) personal or business addresses; (c) email addresses; and (d) information contained in any image, file, photograph, or profile submitted by you to the Company.
The Website may link with digital advertising and social media platforms, including, without limitation, those operated by Meta Platforms, Inc., Google LLC, X Corp., and LinkedIn Corporation. In the event that you link from a social media account to the Website, the Company may collect information about such account and may share information with such account as described in the applicable connection process. AEEM SHIPPING SHALL NOT BE RESPONSIBLE OR LIABLE FOR THE DATA PRACTICES OF ANY LINKED PLATFORM, and your use of any such platform shall be governed solely by such platform's own terms of service and privacy policy, which you are advised to review prior to linking.
You may elect not to provide Personal Information, subject to the controls offered by the operating system of your device; provided, however, that any such election may prevent you from receiving or accessing certain features of the Services.
AEEM Shipping also collects information relating to the Services that does not personally identify an individual (hereinafter, "Non-Personal Information"), including, without limitation, the pages you view, your browser type and language preference, your referring site, the city and state in which you are located (but not your precise geolocation), the date and time of each request, and unique identifiers that are not connected, and cannot reasonably be connected, to your identity. The Company's purpose in collecting Non-Personal Information is to better understand how visitors use the Services. The Company shall not use Non-Personal Information in an attempt to identify you, and in the event the Company associates any Non-Personal Information with information that personally identifies you, such information shall thereupon be treated as Personal Information hereunder. As further described in Section 4 hereof, the Company may employ Cookies and other automatic information-gathering technologies to collect both Personal Information and Non-Personal Information.
Information collected through the Services may be collected by the Company or by one or more of the third parties utilized by the Company in providing the Services.
The Company may use the information it collects for one or more of the following purposes: (a) to provide, operate, maintain, and protect the Services; (b) to establish, maintain, and protect accounts used to access the Services; (c) to improve the Company's online operations, process transactions, and provide customer service; (d) to communicate with you, including account-related or transaction-related communications and other communications relating to the Services; (e) to send or display offers and other content customized to your interests or preferences; (f) to detect and prevent fraud and other misuse; (g) to perform research and analysis directed at improving the Company's products and services and developing new products or services; (h) to manage and maintain the systems that provide the Services; (i) to comply with the Company's legal and regulatory obligations and to establish, exercise, or defend the Company's legal rights; and (j) for any other purpose disclosed to you at the time of collection or otherwise undertaken with your consent.
The Company may disclose your Personal Information as necessary to provide the Services, or when you authorize or instruct the Company to do so.
The Company may also disclose Personal Information and Non-Personal Information to Service Providers. As used herein, "Service Providers" means companies, agents, contractors, service providers, or other parties engaged to perform functions on the Company's behalf, including, without limitation, payment processing, data storage, website hosting, marketing, and audits. When the Company engages a Service Provider, the Company shall require that such Service Provider use and disclose the Personal Information received from the Company solely to provide its services to the Company or as otherwise required by applicable law.
The Company may also disclose Personal Information and Non-Personal Information to Online Tool Providers. As used herein, "Online Tool Provider" means a licensor of software that the Company includes in, or uses with, the Services, including an application programming interface (API) or software development kit (SDK), that provides a specialized function or service to the Company and that requires the transmission of Personal Information and/or Non-Personal Information to such Online Tool Provider. Online Tool Providers may have the right to use Personal Information and Non-Personal Information about you for their own business purposes.
The Company may also disclose your Personal Information to third parties when the Company believes, in good faith and in its sole and absolute discretion, that such disclosure is reasonably necessary or appropriate to: (a) enforce or apply the terms and conditions governing the Services, including the investigation of potential violations thereof; (b) comply with applicable law, regulation, legal process, or an enforceable governmental request; (c) protect the rights, property, or safety of AEEM Shipping, its users, or any third party; (d) submit insurance claims, cooperate with insurance investigations, and fulfill insurance subrogation activities; (e) prevent a crime or protect national security; or (f) detect, prevent, or otherwise address fraud, security, or technical issues.
Finally, AEEM Shipping reserves the right to transfer or assign information (including, without limitation, your Personal Information) to a third party or successor-in-interest in connection with, or in contemplation of, any merger, acquisition, reorganization, financing, or sale or other transfer of all or substantially all of the assets of the Company relating to the Services, or in the event of any bankruptcy, liquidation, or receivership of the Company's business, in each case without your further consent. The Company shall use commercially reasonable efforts to notify you of any such transfer, including, by way of example and not limitation, via email or by posting notice on the Website.
Each time you use the Services, the Company may collect certain information regarding such use, and the Company may use your device's unique identifier or other unique identifiers to assist the Company in collecting and analyzing such data.
To assist in collecting and storing such information, the Company may employ Cookies, local browser storage, and web beacons, pixels, or tags. As used herein, "Cookie" means a small amount of data that a website operator, or a third party whose content is embedded in such website, may store in your web browser and access when you visit the website. As used herein, a web beacon, pixel, or tag means a small image placed on a web page that permits its operator to read or write a Cookie.
Your operating system and web browser may permit you to erase information stored in Cookies and local browser storage. If you do so, you may be required to log in to the Website again and may lose certain preferences or settings. You may also be able to configure your browser to refuse website storage or to indicate when such storage is permitted; provided, however, that certain features of the Services may not function properly without it. The Company may use Cookies to keep you logged in, to save your preferences, and to collect information regarding your use of the Services.
Online Tool Providers, Cookies, web beacons, pixels, tags, and similar third-party technologies are collectively referred to herein as "Tracking Technologies." AEEM Shipping uses Tracking Technologies to identify and track visitors, their usage of the Services, and their website access preferences. The use and disclosure of information by third-party Tracking Technologies are described in their respective privacy policies, and certain Tracking Technologies may permit you to opt out of certain collection and/or uses of your information. For further information regarding the privacy practices of the Tracking Technologies that AEEM Shipping currently uses (and/or reserves the right to use), please refer to the following:

You may also control or disable Cookies through your browser settings; provided, however, that certain features or functionality of the Services may not operate properly if certain Cookies are disabled.
The Company may work with advertising and analytics partners that use Cookies and similar Tracking Technologies to collect information regarding your interactions with the Services over time and across different websites or online services. Such partners may use such information to provide analytics services and to deliver advertising, including interest-based advertising. The use of information by such partners shall be governed solely by their own respective privacy policies.

Because no industry standard currently exists for the interpretation of DNT signals, the Website does not respond to browser DNT signals at this time. Certain browsers and browser extensions also support the Global Privacy Control ("GPC") signal. Because AEEM Shipping does not Sell or Share Personal Information (as such terms are defined under applicable California law), the Company's data practices do not change in response to a GPC signal; provided, however, that you may manage Cookies and other Tracking Technologies as described in this Policy.

AEEM Shipping does not knowingly collect Personal Information from children under thirteen (13) years of age. In the event the Company becomes aware that it has collected Personal Information from a child under thirteen (13) years of age, the Company shall take commercially reasonable steps to promptly delete such information as required by applicable law, including the Children's Online Privacy Protection Act ("COPPA"). If you believe that a child under thirteen (13) years of age has provided the Company with Personal Information, please contact the Company using the information set forth in Section 11 hereof.
AEEM Shipping employs commercially reasonable administrative, technical, and physical safeguards designed to protect your Personal Information against unauthorized access, use, modification, disclosure, or destruction. NOTWITHSTANDING THE FOREGOING, NO METHOD OF TRANSMISSION OVER THE INTERNET AND NO METHOD OF ELECTRONIC DATA STORAGE CAN BE GUARANTEED TO BE ONE HUNDRED PERCENT (100%) SECURE. ACCORDINGLY, WHILE AEEM SHIPPING STRIVES TO USE COMMERCIALLY ACCEPTABLE MEANS TO PROTECT YOUR PERSONAL INFORMATION, AEEM SHIPPING DOES NOT AND CANNOT GUARANTEE THE SECURITY OF ANY INFORMATION TRANSMITTED TO, THROUGH, OR STORED BY MEANS OF THE SERVICES, AND ANY SUCH TRANSMISSION IS MADE AT YOUR SOLE RISK.
The Company restricts access to Personal Information in its possession, on a need-to-know basis, to those employees, Service Providers, and Online Tool Providers who require such information in order to operate, develop, improve, or support the Services.
The Services may link to or integrate with third-party sites, services, or applications that are not operated by the Company. AEEM SHIPPING SHALL NOT BE RESPONSIBLE OR LIABLE FOR THE PRIVACY OR SECURITY POLICIES, PRACTICES, OR CONTENT OF ANY SUCH THIRD PARTY, AND AEEM SHIPPING HEREBY EXPRESSLY DISCLAIMS ANY AND ALL LIABILITY ARISING FROM OR RELATING TO YOUR ACCESS TO OR USE OF ANY THIRD-PARTY SITE, SERVICE, OR APPLICATION. You are encouraged to review the privacy policies and terms of service of each such third party.

You may determine when this Policy was last revised by referring to the "Last Updated" legend appearing at the top of this Policy. If the Company makes material changes to this Policy, the Company shall notify you by reasonable means, which may include email or the posting of a notice on the Website prior to such changes taking effect. YOUR CONTINUED ACCESS TO OR USE OF THE SERVICES FOLLOWING THE EFFECTIVE DATE OF ANY MODIFICATION TO THIS POLICY (WHICH EFFECTIVE DATE SHALL BE THE "LAST UPDATED" DATE SET FORTH ABOVE) SHALL CONSTITUTE YOUR ACCEPTANCE OF SUCH MODIFICATION.
